Terms and Conditions of Sale
Eligibility
Firearms may be purchased prior to the grant or variation of a Firearm Certificate (FAC) in accordance with Guernsey practice.
However:
No firearm will be transferred into the possession of any customer unless a valid FAC is produced authorising that specific firearm
It is the sole responsibility of the purchaser to obtain and maintain all required certification
Elite Firearms (RFD26) accepts no responsibility for any refusal, delay, revocation, or restriction relating to an FAC
Where a customer fails to obtain the required certification within a reasonable period, the transaction shall remain incomplete and the firearm shall be treated as non-transferable in accordance with these Terms and Conditions
Compliance with Law
All transactions are subject to the Firearms and Weapons (Guernsey) Law, 1998 and any applicable regulations. Elite Firearms (RFD26) reserves the right to refuse any transaction where legal, safety, or compliance requirements are not fully satisfied.
Order Acceptance
All orders are subject to verification and legal compliance. A transaction is not deemed complete until:
all legal requirements are satisfied; and
the firearm is lawfully transferred
Payment alone does not constitute completion of sale.
Non-Disclosure
Customers must disclose any information that may affect their legal eligibility to acquire firearms. Failure to disclose relevant information may result in:
cancellation of the transaction; and
no obligation on Elite Firearms (RFD26) to proceed or refund
Payment and Refunds
All payments are made subject to compliance verification.
Where a transaction cannot be completed due to:
absence of a valid FAC
refusal, revocation, or restriction of certification
non-disclosure or misrepresentation
No refund will be issued.
Firearms / Parts, Accessories and Magazines – Returns
Due to the nature of firearms & components, parts, accessories, and magazines:
All such items are sold as non-returnable and non-refundable once supplied
It is the customer’s responsibility to ensure compatibility and legality prior to purchase
No refunds or exchanges will be provided for:
incorrect selection
incompatibility
change of mind
Nothing in this clause affects your statutory rights in respect of defective or misdescribed goods.
Condition, Damage and Liability
All firearms and related items are supplied in good faith and in the condition described at the time of sale.
Elite Firearms (RFD26):
shall not be liable for damage, wear, or failure arising from:
use, misuse, modification, or poor maintenance
third-party handling or transfer
ammunition or components used
accepts no responsibility for any indirect or consequential loss
Where an issue is identified, we will make reasonable efforts to:
assess the matter; and
where appropriate, assist in identifying a practical solution
Any remedy offered is at the discretion of Elite Firearms (RFD26).
Storage
Firearms may be held in secure storage pending lawful transfer.
Elite Firearms (RFD26) reserves the right to charge storage fees at its discretion. Storage does not create any obligation to complete a transaction or transfer ownership.
Non-Transferable / Uncollected Firearms
Where a customer is unable to lawfully take possession of a firearm, including but not limited to:
failure to obtain or hold a valid FAC
legal restriction or prohibition
refusal or revocation of certification
the transaction shall not be considered complete.
The firearm shall remain in the lawful possession and control of Elite Firearms (RFD26).
The customer must provide lawful transfer instructions to a suitable FAC holder or licensed firearms dealer within 14 days of written notice.
Where:
no lawful transfer is possible; or
no valid instructions are received within that period
Elite Firearms (RFD26) reserves the right to:
cancel the transaction; and
sell or otherwise dispose of the firearm in accordance with applicable law
Any proceeds of sale may be used to cover reasonable costs including storage, administration, and resale.
No refund obligation arises where the customer is unable to lawfully complete the transaction.
Dealer Discretion
Elite Firearms (RFD26), as a Registered Firearms Dealer, reserves the right to:
refuse to act on instructions
refuse to facilitate transfers
refuse involvement with third parties
where it is considered necessary for legal, safety, or compliance reasons.
Title and Possession
No ownership or title shall pass until:
all legal requirements are met; and
lawful transfer has taken place
All firearms remain in the possession and control of Elite Firearms (RFD26) until such time.
Limitation of Liability
Elite Firearms (RFD26) shall not be liable for:
failure to complete a transaction due to legal or licensing restrictions
delays caused by regulatory or compliance processes
Amendments
Elite Firearms (RFD26) reserves the right to amend these Terms and Conditions at any time. Updated terms shall apply to future transactions and, where applicable, ongoing arrangements.
Governing Law
These Terms and Conditions are governed by the laws of Guernsey.
